The FD & D Class Rules & Circulars

FD&D cover provides practical support and expert assistance to members in avoiding and, where necessary, resolving disputes involving the operation of their ships.

Details of the cover are set out in the FD&D Rules for 2010/11, which can be downloaded from this site. However, some features of FD&D insurance and the operation of the Class are highlighted below:

  • It offers cover for legal costs and expenses resulting from a wide variety of disputes including claims:
    • Under charterparties or bills of lading.
    • Resulting from the supply to a ship of defective fuel or equipment
    • Arising in connection with the building, purchase or sale of a vessel
    • For amounts due from underwriters
    • By or against masters, officers, crew or passengers
    • For salvage services.
  • FD&D cover is provided on a discretionary basis. Members can be reassured that the merits of claims involving the Class will be carefully evaluated – with close ongoing attention paid to the provision of proper and proportionate support in appropriate cases
  • The Bilbrough legal team of barristers and solicitors is based in its London, Hong Kong and Piraeus offices. Many members benefit from the availability of ‘on the spot’ support and experience to assist their FD&D claims. And such in-house expertise is to hand generally, to provide guidance to the membership on a range of issues – from analysis of topical legal issues and developments, to the review and interpretation of prospective charterparty clauses
