Some Members may already be aware that the Grain Board of Iraq (GBI), part of the Ministry of Trade, has recently introduced a Regulation which requires the Shipowner’s “P&I Representative” to sign various outturn documents upon completion of discharge.  The new requirement applies to the Outturn Report, the Statement of Facts and any Shortage Report or Protest against Shortage/Damage.

Members will be aware of the dangers associated with the carriage of cargoes that can liquefy from the various Circulars, News Alerts and Stop Loss articles issued by the Club over recent years. The principal concern has been in respect of the carriage of iron ore fines from India and Brazil as well as nickel ore from the Philippines and Indonesia. More recently, the Club has highlighted problems associated with the carriage of iron ore fines from Sierra Leone.

Members will recall our recent News Alert dated 19th October 2012 reporting on new proposed EU measures targeting Iran. These measures have now been implemented by EU Regulation 1263/2012 published on 21 December 2012. In response to the recent increase in the level of attacks against shipping, industry organisations (including BIMCO, ICS, INTERCARGO and INTERTANKO) have issued Interim Guidelines for Owners, Operators and Masters for protection against piracy in the Gulf of Guinea region. A copy of these Interim Guidelines is attached.

Members will be aware of the requirement that owners/operators of (a) any ship carrying polluting and hazardous cargoes in bulk or (b) any other ship above 10,000 gt enter into a pollution clean-up contract with a Maritime Safety Agency (MSA) approved ship pollution response company (SPRO) before the ship enters a PRC port. The International Group of P&I Clubs has previously recommended the use of a pollution clean-up contract and the latest amended version is attached.

Members will be aware from the International Group FAQs on Chinese Pollution Regulations that Owners will need to contract with a Ship Pollution Response Organisation (SPRO) for their pollution response in a particular port in China. Members will also recall that SPROs based in a particular port may form an alliance with SPROs in other ports to create a consortia that will assist Members in the various different ports that the consortia covers.

The EU by way of Council Decision 2012/635 of 16 October 2012 has proposed new measures targeting Iran. At this point in time, the measures are only proposals and an implementing Regulation will be required to make them binding on companies and individuals.  The timing of such an implementing Regulation remains unclear.     A copy of the Council Decision 2012/635 can be found attached to this alert.
