Following on from the Club’s previous News Alerts concerning the 2020 ‘Global Sulphur Cap’, ship owner/operator Members who have chosen to achieve compliance with MARPOL Annex VI by using low sulphur compliant fuel oil should note that the International Chamber of Shipping (ICS) Guidance originally issued in September 2018 has been updated.

As Members are already aware from our News Alert of 15 February 2019, the US imposed sanctions against Venezuela’s oil sector, including designating Petroleos de Venezuela SA (“PdVSA”) as a sanctioned entity pursuant to Executive Order 13850 (“EO 13850”). Previous legal advice obtained on EO 13850 and FAQ 657 from Freehill Hogan & Mahar LLP indicated that non-US persons/entities were still free to trade with and carry PdvSA cargoes, in certain circumstances.
