Members will recall our News Alert of 19 August 2011 (click here), which identified the almost certain need to enter the AdditionalPremiumArea for War Risks in the Indian Ocean (the AP Area) when transiting the Indian Ocean rather than attempt to maintain a route within 12nm of the Indian Coastline to avoid it. This is due to added navigational difficulties, particularly for deeply drafted vessels. One of the hazards identified was increased proximity to local fishing boats.

Members will be aware from our News Alert of June 2011 (click here) that the International Maritime Organisation’s Maritime Safety Committee (IMO MSC) had previously released guidance relating to the deployment of armed security personnel on board vessels for Flag States and, separately, to those employing armed security personnel from private security companies (Rev 1). Members will recall the recent News Alert of 27 March 2012 reporting on the latest EU restrictions on the transport of crude oil and petroleum or petrochemical products from or originating in Iran (click here to read the previous alert). A further alert (on 29 March) provided a link to the FAQs drafted by the International Group of P&I Clubs to assist Members in their understanding of the EU restrictions and their effect on P&I insurance and Shipowners.

Members should note that the Correspondent in Senegal, TCI Africa, has informed the Club of an alarming trend in respect of fines imposed by the customs authorities in Dakar for alleged breaches of the local customs code. It appears that the customs authorities are rigorously auditing ship's declarations of stores, bunkers and consumables and then imposing draconian fines where any error has been made in the declaration.

The Correspondent for Indonesia, Spica Services, reports that the Ministry of Energy and Resources is imposing a ban on the export of certain unprocessed mining commodities including metal minerals such as nickel ore, iron ore and iron sand. Regulation No. 7 of 2012 "Increase in Mineral's Added Value Through Mineral's Processing and Refined Activities" is to come into force as from 6 May 2012. A copy of the Regulation is attached.

Members will be aware from the International Group FAQs on Chinese Pollution Regulations that a Ship Pollution Response Organisation (SPRO) based in a particular port may form an alliance with SPROs in other ports to create a consortia that will assist Members in the various different ports that the consortia covers. The latest translated list of consortia as of 1 April 2012 is attached to this alert.
