Members will be aware from the International Group FAQs on Chinese Pollution Regulations that a Ship Pollution Response Organisation (SPRO) based in a particular port may form an alliance with SPROs in other ports to create a consortia that will assist Members in the various different ports that the consortia covers. The latest translated list of consortia as of 23 March 2012 is attached to this alert.

Members may be aware that there are various companies that offer the service of agent for the purposes of contracting with SPRO's (Members will note from the News Alert containing the Chinese Pollution Regulations FAQs the circumstances in which they can use an agent). The agent must be domiciled in mainland China and must meet certain requirements laid down in the Notice issued by the China MSA dated 22 December 2011.

Members will be aware of previous Circulars and News Alerts concerning the recent Regulations introduced in China in respect of prevention and control of marine pollution from ships, including FAQs and lists of Consortia and SPROs (translated into English) produced by the Pollution Sub-Committee of the International Group (the IG). The IG has continued to liaise with the China MSA, various ship pollution response organisations (SPROs), shipowners and other interested parties.

Further to our News Alert of 9th February 2012, the EU Regulation which implements the restrictions proposed in the EU Decision of 23rd January 2012 was published on 24th March 2012. The EU Regulation has immediate effect and a copy of the EU Regulation can be found by clicking here. The Club have had reports from Brazil that there has been in a large increase in claims arising out of the liquefaction of bauxite cargoes being shipped from the Amazon basin area. As Members may be aware, Bauxite has been listed as a Group C cargo in the International Maritime Solid Bulk Cargoes Code (IMSBC Code).Group C consists of cargoes which are not liable to liquefy and do not possess chemical hazards. Thus bauxite is not a cargo one would ordinarily expect to be prone to liquefaction.

The latest round of EU proposed measures against Iran were published in Council Decision 2012/35 on 23rd January 2012. Whilst the EU Decision has immediate effect on EU Member States, they are not to be binding on individuals and corporations until the EU Regulation has been issued which implements the proposed measures.

The recent tragic loss of the supramax bulk carrier, Vinalines Queen, entered with the London P&I Club, has received wide coverage in industry media. Prior to the casualty, last contact with the vessel was whilst on a voyage from Indonesia to China loaded with a cargo of nickel ore and all but one of the 23 crew were lost.

Members will be aware that the Club issued a Circular on 7 December, setting out what was at that time the latest information in relation to the Chinese Pollution Regulations. Members should note that the second annex of the 7 December Circular referred Members to a Pollution Response Contract as recommended by the International Group. Whilst the Chinese text is correct, a discrepancy has been found in Article 3.3 of the English contract wording.

Whilst the list is published only in Chinese, the International Group are endeavouring to assist Members by translating the list into English.
